A-Rod fine after treatment on knee, shoulder (AP)

NEW YORK ? The New York Yankees say star third baseman Alex Rodriguez is totally fine after having special treatment on his right knee and left shoulder in Germany earlier this month.

The 36-year-old Rodriguez had plasma-rich platelet injections following a recommendation from Los Angeles Lakers star Kobe Bryant. Yankees general manager Brian Cashman said Wednesday that the team gave its permission after vetting the process.

Rodriguez's treatment was first reported by the New York Post.

Cashman says the therapy is in "complete compliance" with WADA and Major League Baseball regulations. He also said the treatment is performed in the United States. The Yankees say Rodriguez went to the doctor in Germany because he's at the top of this field.

Rodriguez had surgery on his right knee last July and saw his power drop in the second half and postseason. He played in 99 games and hit 16 home runs. He has 629 career homers.

Cashman says Rodriguez is "100 percent" right now and that there are "no red flags" going into spring training. Cashman says he expects Rodriguez to be able to play every day.

The Yankees also said they've reached agreement with 37-year-old lefty Hideki Okajima for a nonroster invite to spring training. Once a staple of the Boston bullpen, he spent most of last year in Triple-A for the Red Sox. The Yankees envision him as a possible lefty specialist.

(AP) ? Six members of a Texas family apparently opened Christmas presents just before a relative dressed as Santa Claus showed up, opened fire and killed them before killing himself, police said Monday.

Grapevine police spokesman Sgt. Robert Eberling said the shooter showed up in the Santa outfit shortly before gunfire erupted and was a member of the family. The identity of the shooter and the victims will be released after autopsies are conducted Monday, he said.

Police went to the apartment midday Sunday after dispatchers received a phone call in which no one was on the line. They found four women and three men, aged 18 to 60, dead. A motive for the shootings remains unclear.

Investigators worked overnight, meticulously searching the apartment, along with three vehicles parked outside.

"It appears they had just celebrated Christmas. They had opened their gifts," Grapevine Police Sgt. Robert Eberling said Sunday, adding that the apartment was decorated for the holiday, including a tree.

Two handguns were found near the bodies, and it appears all died of gunshot wounds, he said.

Grapevine Police Lt. Todd Dearing said investigators believe that the victims were related, though some were visiting and didn't live in the apartment. He said police are looking for other relatives to inform of the deaths.

"Seven people in one setting in Grapevine, that's never happened before. Ever," Dearing said.

Many of the nearby apartments are vacant, and police said no neighbors reported hearing anything on a quiet Christmas morning when many people were not around.

Jose Fernandez, a 35-year-old heavy equipment mechanic who moved to the complex with his family about six months ago, said he always felt safe in the area, but is now afraid to let his 10-year-old son play freely outside.

"This is really outrageous especially on Christmas," said Fernandez, who was visiting family for the holiday and returned to find several police cars parked outside his home.

"This has shocked everybody. It has scared everybody. I guess something like this can happen anywhere, but seven people dead. It's just very scary," he added.

Final unit at The Mark sells for $2.2M ? San Diego Union

The last unit of a downtown San Diego condo project that opened with fanfare in July 2007 but sank during the housing bust has been sold, public records show.

The 32nd-floor penthouse of The Mark was purchased for $2,225,000, more than four years after the upscale project was completed. The original developer, Doug Wilson, sold the struggling 244-unit property at a loss in 2009 to the RADCO Cos., an Atlanta-based firm that turns around distressed real estate.

Property records show the buyers of the penthouse, north of Petco Park, are Daniel E. Welden and Kathy Welden. Daniel E. Welden is the president of EMPI Inc., an Anaheim-based automobile-parts company. The Weldens are residents of Newport Beach in Orange County.

?We own another one in that building,? Daniel E. Welden said Thursday. ?We?ve been there for over two years.?

The home, essentially a shell, has 3,700 square feet of interior space and more than 1,700 square feet of outer area that includes a terrace and balcony, RADCO officials said.

?The penthouse is a blank canvas that will allow the new owner to build to their personal specifications,? Victor Valentine, director of sales at RADCO, said in a statement.

Kevin Price, an executive at RADCO?s Los Angeles office, said The Mark?s marketing strategy targeted two types of buyers: first-timers and Baby Boomers who sold larger homes to move closer to the city core.

When RADCO bought the distressed condo project, 125 of the 244 units were unsold. The company closed on 53 in 2009, 59 in 2010 and the rest this year.

Wilson, the original developer, told the Union-Tribune in July 2009 a big reason he sold The Mark was that his main financing partner, Lehman Bros., filed for bankruptcy protection. (See: Developer hoping to make its mark)

Arizona sheriff faces new setback over immigration

(AP) ? America's self-proclaimed "toughest sheriff" has been dealt another setback to his immigration enforcement efforts by a federal judge's ruling that bars deputies from detaining people based solely on the suspicion that they're in the country illegally.

The ruling issued Friday sets the stage for a possible trial in a lawsuit that alleges racial profiling in the patrols in Arizona's Maricopa County, and would further limit Sheriff Joe Arpaio's immigration authority after Washington yanked his federal powers earlier this month.

Lawyers pushing the lawsuit on behalf of five Latino clients also won class-action status that lets other Hispanics join the case if they have been detained and questioned by Arpaio's deputies as either a driver or passenger in a vehicle since January 2007.

U.S. District Judge Murray Snow hasn't yet ruled on the ultimate question of racial profiling, but notes the case's evidence could lead a judge or jury to conclude that Arpaio's office racially profiles Latinos.

"Sheriff Arpaio has made public statements that a fact-finder could interpret as endorsing racial profiling," Snow said.

The judge noted that the sheriff has said that even without authority to enforce federal immigration laws, his officers can detain people based upon their speech or they appear to be from another country.

The 40-page ruling marked a qualified victory for the lawyers who pushed the lawsuit. They didn't get the case decided without going to trial, as they had hoped, but it came closer to the result they were looking for.

"We are encouraged by the Court's recognition of the strong evidence showing the (Maricopa County Sheriff's Office's) pattern and practice of racial profiling and its conducting of operations for reasons that are racially biased," Stan Young, lead attorney for those who filed the lawsuit, said in a written statement.

Arpaio won a small victory when the judge dismissed part of a claim by a Hispanic couple who are among the five people who filed the lawsuit.

Snow ruled that one of Arpaio's deputies had probable cause to pull over the couple on a closed roadway. The couple's illegal search claim was thrown out, but the judge didn't dismiss their racial profiling claim.

Messages left for Arpaio's lawyers weren't immediately returned late Friday.

The lawsuit alleges that Maricopa County officers made some traffic stops solely because Hispanics were driving. The plaintiffs say authorities had no probable cause to pull them over and made the stops only to question their immigration status.

Arpaio has denied the racial profiling allegations, saying people pulled over in the patrols were approached because deputies had probable cause to believe they had committed crimes and that it was only afterward that deputies found many were illegal immigrants.

During the patrols known as "sweeps," deputies flood an area of a city ? in some cases, heavily Latino areas ? over several days to seek out traffic violators and arrest other offenders. Illegal immigrants accounted for 57 percent of the roughly 1,500 people arrested in the 20 sweeps conducted by his office in earnest since January 2008.

Separate from the lawsuit, the U.S. Department of Justice issued a Dec. 15 report that accused Arpaio's office of having a pattern of racially profiling Latinos, basing immigration enforcement on racially-charged citizen complaints and punishing Hispanic jail inmates for speaking Spanish.

Arpaio faces a Jan. 4 deadline for saying whether he wants to work out an agreement to settle the civil rights allegations. The Justice Department has said it's prepared to sue Arpaio and let a judge decide the matter if no agreement can be worked out.

The Justice Department report prompted U.S. Department of Homeland Security to strip Arpaio's office of its federal powers to verify the immigration status of jail inmates. The severing of those ties came after an October 2009 decision by Homeland Security to take away the federal immigration arrest powers from 100 of Arpaio's deputies.

Arpaio is left with only state immigration laws to carry out his patrols ? and those powers were limited by the judge Friday.

Apart from the lawsuit and civil rights report against the sheriff's office, a federal grand jury also has been investigating Arpaio's office on criminal abuse-of-power allegations since at least December 2009.

Grand jurors are examining the investigative work of the sheriff's anti-public corruption squad.

Scott Weiland's 'Winter Wonderland' Frame By Frame

With Christmas just around the corner, it's safe to assume you're enveloped in holiday tunes — whether inescapably at the mall or blaring from your laptop by choice. Beyond the old standards, there's Michael Bublé's chart-topping Christmas album and even Justin Bieber's first Christmas contribution, Under the Mistletoe, but you might not be aware that Stone Temple Pilots frontman Scott Weiland released his own holiday disc this year.

That's right, and while Weiland's The Most Wonderful Time of the Year dropped back in October, even some of his contemporaries were unaware of his Xmas effort. That gave us the perfect opportunity to share the album's first music video with the bands on the bill at KROQ's annual Almost Acoustic Christmas earlier this month. In true holiday spirit, the artists graciously took us through the kitschy retro-themed clip for "Winter Wonderland," frame by frame.

Initially, everyone was surprised by the video, in part due to Scott's never-before-heard classic croon, but also by his "Mad Men"-inspired, clean-cut new look.

"I like his scarf a lot," Marcus Mumford of Mumford & Sons said.

"He's very handsome," fellow bandmember Winston Marshall added.

While the reactions ran the gamut from "good" to "insane," there were other clues in the video, some believed, that this whole thing might be more of a wink and a nod than a serious musical venture.

"He kinda has a very weird eyebrow thing that I only noticed now for the first time," Grouplove's Ryan Rabin said.

"I can't tell if it's tongue-in-cheek or not," Mark Foster of Foster the People wondered. "You think it's tongue-in-cheek or you think he just lost his mind? 'Cause he definitely had a bout with [in]sanity for a while."

Of course, the sight of a '90s rock icon cozying up to the Yule log left some baffled, but Death Cab for Cutie had their own take on Weiland's "Wonderland."

"I mean, is he more Bing Crosby or is he more Danny Kaye?" DCFC's Chris Walla asked.

"He's got a lotta Bing, he's got a lot of ... I mean there's some Sinatra there too," DCFC bassist Nick Harmer said.

They both agreed that Weiland was fully committed to the act.

"And it's good! It's classic," Walla said.

"Thank you! I mean — yeah! Thanks for making that Scott, seriously," Harmer concluded.

Hoop dreams bring Israelis, Palestinians together

JERUSALEM -- "Shlomi, throw me the ball."

"Assi, it's your turn, pass and dribble."

"Mahmud, great pass. What a basket."

This might sound like a normal basketball game but?it's not. The unique?endeavor?can be best described as an "oasis of coexistence" in Israel?where Jews, Muslims and Christians play not only on the same court but in mixed teams.


In 2001, American brothers Sean and Brendan Tuohey founded PeacePlayers International with the premise that children who play together can learn to live together.

It seemed quite obvious during my visit to practice that the Tuohey brothers were succeeding. Here on the court?at the "Hand in Hand" bilingual school in Jerusalem, Israelis and Palestinians were laughing together, hugging each other and, most importantly, shooting the ball together.

"At first the kids and their parents were hesitant with some kids even crying," says Karen Doubilet, who is the PeacePlayers International's?Middle East managing director. "But the transition is very fast, now they jump in joy and hug each other when they meet on and off the court."

'They are like me'
After?experiencing so much?hatred between Israelis and Palestinians, it was refreshing and exciting to see how naturally these kids reacted and played with each other.

Malak Ayub, 12,?is a Muslim girl from the East Jerusalem village of Shoafat.

"Before I came to this program I thought Israelis only wanted to do bad things to us but now I see that they are like me, they want to play together," she said.

One of Malak's best friends is Hadas Prawer, a 14-year-old Israeli from the neighborhood of Mevaseret, which is located west of Jerusalem. I asked Hadas what?she tells?her friends when they hear she plays with Palestinians.

"I don't care what people think or say, I'm having fun and that's it," she said, before turning around and giving Malak a?huge hug.

The traditional Hanukkah 'Sufganiyot' -- the Jewish ball-shaped doughnuts -- were waiting on the sidelines as a reward for the kids' hard work.?All the?children were wearing T-shirts with the US AID logo on the back, indicating the backing by the US.

"Basketball is huge, especially with the girls," Doubilet added. "Most of these kids don?t have a constructive framework and we give them this activity almost for free. The relationships here will no doubt shape the way Israelis and Palestinians think of each other in the future".

About?550?young people aged from six?to 18 enrolled in this program in the past year, bridging communities in Israel like Jaffa, Tamra and Jerusalem where Jews and Muslims live next to each other.?

Haled Sabah is a 20-year-old Palestinian from Shoafat. He joined the program seven years ago and is now one of its coaches.

"I see some racism on both sides but when kids play on the same team they just see each other simply as people," he said.?

Variable dark energy could explain old galaxy clusters

Does dark energy change over time? An alternative model of the as yet undetected entity that is thought to be accelerating the universe's expansion could explain some puzzling observations of galaxy clusters. But it will have to jump many more hurdles to compete with the simplest and so far most successful model of the elusive entity.

That model, called the cosmological constant, holds that there is a certain amount of repulsive energy in every cubic centimetre of space, and that amount stays the same over time. As the universe expands, more space exists, and so the expansion accelerates.

Now Edoardo Carlesi of the Autonomous University in Madrid, Spain, and his colleagues have simulated a universe where the amount of repulsive energy per unit of volume changes with time.

They say the model can explain how several galaxy clusters grew to weigh as much as a quadrillion (1015) suns by the time the universe was just 6?billion years old. That's a puzzle because some researchers say 6?billion years would not have been enough time for gravity to amass such large structures.

Standard recipe

The puzzle arises if the standard "recipe" for the universe is used. The ingredients for that recipe are a large amount of dark energy, in the form of a cosmological constant, and a dollop of matter. Their ratio has been calculated by studying the cosmic microwave background, radiation that reveals the distribution of matter and energy in the early universe.

Looking at the cosmic microwave background data through the lens of a different dark energy model can produce different ratios of ingredients. The cosmological constant model allows for matter to make up 27 per cent of the universe's energy density, whereas the dark energy model studied by Carlesi's team provides a more generous helping: 39 per cent.

Massive clusters can form up to 10 times as often using this recipe, the researchers say. "You can explain current observations within a model that allows much more matter," says Carlesi. As a result, galaxies attract other galaxies through their gravitational pull, so massive clusters form faster.

First hurdle

The cluster problem may not even be a problem, though, says Dragan Huterer at the University of Michigan in Ann Arbor. He says the jury is still out on whether the clusters challenge the leading cosmological model, because there is a lot of uncertainty about their mass, most of which is thought to be tied up in invisible dark matter.

The cosmological constant has so far been able to explain a wide range of observations, so turning to a relatively unproven model to account for a few galaxy clusters that may be heavier than expected "is like using a huge hammer to kill a tiny fly", he says.

Carlesi says this is just the first test of the model, and Cristian Armend?riz-Pic?n at Syracuse University in New York agrees. He says the model Carlesi is using should undergo further tests that the cosmological constant has already passed. For example, its effects should be consistent with the integrated Sachs-Wolfe effect, in which photons from the cosmic microwave background experience slight changes in wavelength as they feel the gravity of superclusters of galaxies they pass through.

The week's buzz: We aren't the median

For the last couple of weeks, Life Inc. has been exploring what it?s like to be in the exact midpoint of the nation?s economic spectrum.

The We are the median project prompted thousands of readers to share their stories and thoughts on what it?s like for to live on the nation?s household median income of around $50,000 a year. And it also prompted lots of you to tell us about what it?s like to be much worse off.

Many readers told us they can only hope to bring home $50,000 a year.

?$50,000 would be great to make a year. Single mom with 2 kids and I bring home less than $35,000. Took a cut in hours to keep my job,? one reader wrote in response to our profile of a mom and son who are struggling with a drop in income.

Another profile, of a young couple bringing home around $50,000 a year and juggling high student loan bills, also prompted some to tell us that people need to pay more attention to those who have it much worse.

?Why is this news? We make less than $27K, I have over $80K in student debt. My dream is a nightmare and we are family of 4,? one reader wrote.

Although some readers told us?they are doing just fine?on incomes below $50,000 a year, others said it?s very hard to make ends meet on a lower income. In a post this week about a family choosing to live a very simple life on about $20,000 a year, many readers questioned whether low-income living is really ?living well.??

But some found the story inspirational.

?It's gratifying to hear stories of real people. I applaud this young family and see their lot improving, over time. My husband and I struggled in our early life, with young children and little money. ? Our kids are not scarred because of this, they are all hard working, successful contributors to society. We have always had to be smart about our money and now that we have more, we are still frugal,? one commenter wrote.

Apparently that?s not a lesson many parents are passing on to their children. In a post about a young couple getting a good financial start in life, about 40 percent of our readers said they hadn't learned much from their parents about how to manage money.

?My parents didn't tell me anything about budgeting. It's a hard lesson I now know and am passing this on to my kids,? one reader wrote.

How much would you have to bring home to be free of money worries? More than half of our readers said they would have to make $250,000 or more per year in order to feel rich.

For some, the more money, the better.

?As much as possible. You're never secure in this country unless you are the 1%,? one reader wrote.

Still, some readers said they would settle for much less.

?I would be thrilled with that (to me) mythical $50,000 per year..........!? one reader wrote.
